AI Office denetimindeki yapay zekâ sistemlerinde temel hak otoritelerinin belgeye erişimi
Digital Omnibus on AI (Tüzük (AB) 2026/1744) ile değişen AI Act m.77 uyarınca ulusal temel hak otoriteleri, görevleri için gerekli bilgi ve belgeleri ilgili piyasa gözetim otoritesinden talep edebiliyor. Bu erişim artık Ek III yüksek riskli sistemlerle sınırlı değil.
AI Office’in münhasır denetimindeki sistemlerde piyasa gözetim yetkisi AI Office’te olduğundan (m.75a), talepler AI Office’e yöneliyor. AI Office gerekirse belgeyi sağlayıcıdan isteyebiliyor. Bu nedenle sağlayıcıların teknik dokümantasyonu bu tür taleplere hızlı ve eksiksiz yanıt verecek şekilde güncel tutması önem kazanıyor.
AI Act Article 77: Wider document access for fundamental rights authorities
Fundamental rights authorities can request documents from the AI Office.
Under Article 77 of the AI Act, as amended by the Digital Omnibus on AI (Regulation (EU) 2026/1744), national fundamental rights authorities may request information and documentation from the relevant market surveillance authority, no longer limited to Annex III high-risk systems.
For AI systems under the AI Office’s exclusive supervision, the AI Office holds market surveillance powers (Article 75a), so these requests go to the AI Office, which may in turn obtain documents from the provider. Providers should keep their documentation ready to respond to such requests.
